A Trustee administers the trust for the benefit of its beneficiaries according to the terms of the trust document. We assist Trustees in navigating the trust administration process, including interpreting these often complex documents and making sure that Trustees understand the nature of their duties and how to carry them out. We also provide guidance on such issues as determining the value of the estate and distributing assets.
Should it be necessary for your estate to pass through the probate system, we will explain the terms of the will (if there is one), help you understand the legal requirements of the probate process and guide you in your duties as a Personal Representative. Generally, it is a Personal Representative's responsibility to collect and prepare an inventory of the assets of an estate, manage the assets during the period of administration, pay the bills of the estate, put creditors on notice, make proper distributions to the beneficiaries of the estate, and close the estate once the responsibilities have been completed, all in compliance with the Probate Code. We also assist with any necessary estate litigation matters, including those for the collection and distribution of assets.
There are various techniques and strategies we use to ensure your minor children are protected, cared for and receive your wealth in the way you desire after your passing. We refer to this collectively as Child Safeguard Planning.
Some parents may put off estate planning because they do not believe they have substantial assets to protect. However, all parents should have an estate plan and a child safeguard plan in place to protect and to set forth their wishes for their children, which includes, among other things, the nomination of a guardian in the event that they have an untimely passing while the child is still a minor. We understand the decision of who to nominate as a guardian for your child can be difficult. We are here to guide and assist you in this process. Additionally, we can assist parents should they decide to make changes to an existing guardianship nomination.
In conjunction with nominating a guardian, we can assist with creating a trust, whereby you can choose to distribute assets to your children subject to conditions and circumstances such as age, need, and even incentives based on behavior and education.
Our attorneys will work with you to craft a custom estate plan and child safeguard plan that will protect and care for your children in the way you intend.
We are dedicated to helping you when you have been injured at work. Our law firm provides skilled legal representation for injured workers in workers' compensation cases. Our attorneys will aggressively and zealously advocate your claim. There are no out of pocket costs to our clients. There is no charge to you unless we succeed in obtaining you compensation.
If an employee gets hurt on the job, the employer is required by law to provide workers' compensation benefits. An employee with a work-related injury may receive workers' compensation benefits regardless of who was at fault — the employee, the employer, a co-worker, a customer, or some other third party. Aggressive insurance companies may deny legitimate workers' compensation claims by claiming the injury suffered is not serious enough to qualify for workers' compensation benefits or asserting you have not been injured. Without effective legal counsel, you may lose critical benefits, including wage replacement for lost wages, medical care and financial assistance.
Our experienced attorneys are ready to help you through all aspects of your workers' compensation claim, from filing an initial Application to fighting for your rights on a denied claim. We can help you select the right doctor, who will treat you free of charge, with all costs paid by the insurance company. We will communicate with the insurance company to get our clients the treatment and compensation they deserve so they can focus on healing.
Workers' compensation cases require decisive action because certain issues have particular deadlines that need to be followed. Our attorneys work as a team to protect your rights and obtain results. When you hire Joe, Southard and Yeoh LLP, an experienced attorney will handle your case. If you have been injured, we urge you to contact our office as soon as possible.
